Terms of Service

1. Acceptance of Terms

By downloading, installing, or using FitRival ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and FitRival ("we", "us", or "our"). We reserve the right to update these Terms at any time, and your continued use of the App following any changes constitutes acceptance of the new Terms.

2. Description of Service

FitRival is a mobile fitness application that allows users to:

• Create and join fitness challenges with other users
• Track workout streaks and activity data
• Connect with friends and compete on leaderboards
• Sync health and fitness data from Apple Health (iOS) and Google Health Connect (Android)
• Receive push notifications related to challenges, streaks, and friend activity

FitRival is intended for general wellness and motivational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

3. Eligibility & User Accounts

You must be at least 13 years of age to use FitRival. By using the App, you confirm that you meet this requirement.

Accounts are created through Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us immediately at fitrival@hotmail.com if you suspect any unauthorized use of your account.

You may only create one account. Creating multiple accounts for the purpose of gaining an unfair competitive advantage is prohibited.

4. User Conduct

You agree not to use FitRival to:

• Harass, bully, or threaten other users
• Use offensive, discriminatory, or inappropriate display names or content
• Cheat, manipulate, or falsify activity data or challenge results
• Spam other users with excessive friend requests or challenge invitations
• Attempt to access, tamper with, or disrupt the servers or networks connected to the App
• Use the App for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these conduct standards without prior notice.

5. Health & Fitness Data

FitRival may request access to health and fitness data through Apple HealthKit (iOS) or Google Health Connect (Android), including workout records, step counts, heart rate data, distance, and other activity metrics.

Important:

• We read health data solely to power fitness challenges and display your activity within the App
• Health data is never sold to third parties or used for advertising purposes
• You can revoke health data access at any time through your device's Settings app
• FitRival is not a medical device and health data displayed in the App should not be used for medical decisions
• Always consult a qualified healthcare professional before starting any new exercise program

6. Intellectual Property

All content, design, logos, trademarks, and software within FitRival are the exclusive property of FitRival and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works based on any part of the App without our express written permission.

You retain ownership of any content you create (such as your display name and profile picture), but you grant FitRival a non-exclusive, royalty-free license to use this content to operate and improve the App.

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FitRival, you consent to the data practices described in our Privacy Policy.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any injuries, health issues, or damages that result from physical activities undertaken in connection with the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITRIVAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months prior to the claim (or $10 if you have not made any payments).

10. Termination

We may suspend or terminate your access to FitRival at any time, with or without cause, with or without notice. Grounds for termination include violations of these Terms, fraudulent activity, or extended account inactivity.

You may delete your account at any time through the App's Settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email. Your continued use of FitRival after any changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
